THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.

Our Commitment to Your Privacy

True Recovery RVA is committed to protecting the privacy of your health information. We are required by law to maintain the privacy and security of your protected health information (PHI), to provide you with this Notice of Privacy Practices, and to follow the duties and privacy practices described in this notice.

This Notice applies to all services provided by True Recovery RVA and to health information we create, receive, or maintain in connection with your care.

How We May Use and Disclose Your Information (HIPAA)

We may use and disclose your protected health information without your written authorization for the following purposes:

Treatment

To provide, coordinate, or manage addiction recovery services, including communication among care providers and referrals when appropriate.

Payment

To obtain payment for services provided, including billing insurance or other third parties when applicable.

Health Care Operations

For operational activities such as quality improvement, training, licensing, accreditation, and administrative purposes.

As Required by Law

To comply with federal, state, or local laws, court orders, or lawful processes.

Public Health and Safety

To prevent or reduce a serious threat to health or safety, or for public health reporting as permitted by law.

Use of Third-Party Service Providers

True Recovery RVA uses third-party platforms to support scheduling, forms, communication, and operational services. When protected health information is involved, we work with vendors that are intended to support HIPAA-compliant services and safeguards.

Our website is not intended for the transmission of sensitive or emergency medical information. Online contact forms and electronic communications should not be used for urgent or crisis situations.

 

Your Rights Regarding Your Health Information (HIPAA)

You have the right to:

  • Access and obtain a copy of your health records

  • Request corrections to your health information

  • Request restrictions on certain uses or disclosures

  • Request confidential communications

  • Receive a paper copy of this Notice of Privacy Practices at any time

Our Responsibilities

True Recovery RVA is required to:

  • Maintain the privacy and security of your protected health information

  • Follow the terms of this Notice

  • Notify you following a breach of unsecured protected health information as required by law

We reserve the right to change the terms of this Notice. Any changes will apply to all information we maintain and will be posted on our website.

 

Confidentiality of Substance Use Disorder Records

(42 CFR Part 2 Notice)

Federal law provides additional protections for substance use disorder treatment records under 42 CFR Part 2. These regulations apply to records that identify an individual as having sought or received substance use disorder treatment.

True Recovery RVA may not disclose records that identify a person as having a substance use disorder diagnosis, treatment, or referral for treatment without the individual’s written consent, except as permitted or required by law.

 

Additional Protections for Substance Use Disorder Records

Your substance use disorder treatment records receive greater privacy protections than most other medical records. In most circumstances, we cannot disclose this information to anyone — including family members, employers, courts, or law enforcement — unless:

  • You provide specific written consent

  • The disclosure is permitted by federal law

  • The disclosure is required due to a medical emergency

  • The disclosure is required for audit or program evaluation

  • The disclosure is required by a court order that meets 42 CFR Part 2 requirements

 

Redisclosure Prohibition

Any disclosure made with your consent will include the following notice:

This information has been disclosed to you from records protected by federal confidentiality rules (42 CFR Part 2). The federal rules prohibit you from making any further disclosure of this information unless further disclosure is expressly permitted by the written consent of the individual to whom it pertains or as otherwise permitted by 42 CFR Part 2. A general authorization for the release of medical or other information is NOT sufficient for this purpose.

 

Medical Emergencies

In the event of a medical emergency, True Recovery RVA may disclose necessary information to medical personnel to the extent required to address the emergency.

 

Your Rights Under 42 CFR Part 2

You have the right to:

  • Decide who may receive your substance use disorder records

  • Revoke your consent at any time, except to the extent action has already been taken

  • Request an accounting of certain disclosures

  • Receive a copy of this confidentiality notice

 

Relationship Between HIPAA and 42 CFR Part 2

When both HIPAA and 42 CFR Part 2 apply, the stricter privacy standard is followed. In many cases involving substance use disorder records, 42 CFR Part 2 provides greater protections.
